Application to Giveaways
These Official Rules (“Official Rules”) apply to every giveaway (each a “Giveaway,” and collectively, “Giveaways”) held by StreetWaves Corp. Specific Giveaways may have additional rules (“Specific Rules”) which will be published on the associated Giveaway page. Where the Specific Rules differ from these Official Rules, the Specific Rules will control unless otherwise stated.

BY ENTERING A GIVEAWAY, YOU AGREE TO THESE RULES. THE RULES ARE A BINDING CONTRACT, SO READ THEM CAREFULLY. THESE RULES REQUIRE YOU TO INDEMNIFY AND RELEASE ALL CLAIMS AGAINST THE RELEASED 

PARTIES. BY ENTERING, YOU AGREE TO MANDATORY, BINDING ARBITRATION WITH NO CLASS RELIEF, AND TO LIMITATIONS ON YOUR RIGHTS AND REMEDIES, INCLUDING DAMAGES.

By entering a Giveaway or registering as a StreetWaves Corp. member, you agree that your personal information will be subject to the StreetWaves Corp. Privacy Policy. For more information, see the Privacy Policy and the “Uses of Participant Personal Information; Privacy Policy” section below.

SCAM ALERT: Protect yourself from scams. If selected as a potential Prize winner, StreetWaves Corp. will contact you via the phone number or email provided. You will never be asked for credit card or bank information, or to make a payment to receive a Prize. These are signs of scams. We do not use social media to contact potential winners. Any tax information provided by StreetWaves Corp. via its website is for informational purposes only and should not be considered professional advice. Consult a professional advisor regarding any applicable taxes.

NO PURCHASE NECESSARY; VOID WHERE PROHIBITED.
No purchase, payment, or financial contribution is required to enter or win any Giveaway. All Giveaways are free to enter, and alternative entry methods are always available.

Methods of Entering a Giveaway:

• Membership: By becoming a StreetWaves Corp. member, you receive entries each month based on your membership plan.

• Merchandise: You can gain entries by purchasing products from the StreetWaves Corp. website, subject to the Refund Policy.

• Content: You may receive entries by submitting requested content.

• Free Alternative Method: You can also enter via our Free Entry Portal. Visit the Giveaway Page, scroll to the “Legal Information” section, click the “Free Alternative Method of Entry” link, and submit the entry form before the Giveaway deadline.

Entries are equally eligible regardless of method, and the maximum number of entries per person is 6,000 per month. Any entries beyond this limit will be discarded.

Entry Eligibility:

• Specific Rules: Each Giveaway has additional terms and conditions.

• Eligibility: Giveaways are open to legal residents of the 50 United States, D.C., and Canada (excluding Quebec). Certain restrictions apply based on location and Prize value.

Entry Window:
The start and end dates for each Giveaway are listed in the Specific Rules on the Giveaway Page.

Notification of Win:
Winners are selected through an automated random drawing within ten business days of the Giveaway’s closing. Potential winners are notified via email or phone and must respond within five days. A background check may be required.

Prize Conditions; Taxes:
Prizes are described on the Giveaway Page, and winners are responsible for any taxes. StreetWaves Corp. may issue a Form 1099 for U.S. residents.

Odds of Winning:
The odds of winning are outlined in the Specific Rules.

Prize Payout:
Winners may accept the Prize or, if available, a Cash Alternative, possibly paid in monthly installments. StreetWaves reserves the right to issue either the Prize or the cash prize payout at it’s discretion. 

Vehicle Awards:
Winners are responsible for all costs associated with receiving and owning a vehicle Prize. The vehicle Prize is typically awarded only to U.S. residents. StreetWaves reserves the right to issue the Prize or the Cash Payout Alternative at it’s sole discretion.

Real Property Awards:
Details for real property awards are specified in the Specific Rules.

Award of any Real Property Interest:
Unless otherwise noted in the Specific Rules, winners are responsible for all taxes, costs, and fees associated with any real property interest. If a Giveaway involves real property (e.g., a house) as a Prize, StreetWaves Corp., at its sole discretion, may transfer the deed to the winner. Real property Prizes are only available to legal U.S. residents (excluding Hawaii). Residents outside the U.S. and those in Hawaii will be eligible only for the Cash Alternative.

Award of any Travel Prizes:
For travel Prizes, winners must travel on dates and itineraries specified by StreetWaves Corp. Airfare is coach class, and hotel accommodations are standard unless otherwise noted. Winners and guests must travel on the same itinerary. Winners are responsible for obtaining all necessary travel documents. StreetWaves Corp. is not liable for cancellations, delays, or any third-party issues. Travel insurance is the responsibility of the winner, and StreetWaves Corp. does not provide it. Misconduct by winners or guests can result in trip termination.

Uses of Participant Personal Information; Privacy Policy:
By entering a Giveaway or registering as a member, StreetWaves Corp. collects your personal information, including Registration Data. See the Privacy Policy for details. If there is any conflict between the Privacy Policy and the Rules, the Rules will take precedence.

Important Legal Terms:
StreetWaves Corp. and its affiliates (collectively, the “Released Parties”) are not responsible for errors, lost entries, or technical issues. By entering, you agree to these Rules and waive any claims against the Released Parties. Prizes are provided “as is,” without warranties of any kind, and disputes are governed by the laws of the State of Florida, USA.

Choice of Law and Limitation of Liability:
All disputes will be governed by Florida law, and you agree to waive the right to claim any damages.

Transfer:
The status of a Giveaway winner is non-transferable.

General Conditions; Publicity:
Participants agree to be bound by these Rules and the decisions of StreetWaves Corp., which are final. Prizes are non-transferable and non-substitutable unless StreetWaves Corp. decides otherwise. Participants grant StreetWaves Corp. the right to use their likeness in promotional materials. Winners are responsible for all taxes. StreetWaves Corp. is not liable for any errors or damages related to participation in the Giveaway.

Prize Conditions; Winner’s List:
Winners are responsible for any additional costs not stated in the Prize description. To obtain a list of winners, refer to the Specific Rules for that Giveaway.

Miscellaneous:

• Disqualification: StreetWaves Corp. reserves the right to disqualify any participant who violates these Rules or attempts to undermine the Giveaway.

• Force Majeure: StreetWaves Corp. may modify, suspend, or terminate a Giveaway due to unforeseen events beyond its control.

• Invalidity: If any provision of these Rules is found invalid, the rest remains effective.

• Language: The English version of these Rules prevails in case of discrepancy with translations.

• Governing Law: These Rules are governed by Florida law.

• Arbitration Disclosure: Any disputes will be resolved by binding arbitration under JAMS rules, and participants waive the right to class actions.

Updates:
These Rules may be updated without notice. Changes will apply to Giveaways starting after the update. Review these Rules before entering any Giveaway. The Rules work in conjunction with the Specific Rules, Terms of Service, Subscription Policy, Refund Policy, and Privacy Policy available on StreetWaves Corp.’s website.

Challenge Entries

Gaining entries through challenges can be a very good way to enter our giveaway contests. We issue regular challenges that can help you to get entries into our giveaways. Email giveways@streetwaves.org for more details.

1. Eligibility:

• Participants: The contest is open to all individuals who are members and/or donors of StreetWaves Corp. and meet the age requirements specified in the contest announcement. Membership and/or donations must be current and valid at the time of entry.

2. No Purchase Necessary:

• Entry: No purchase or contribution is  ever necessary to enter our contests. All entries must be received by the specified deadline to be eligible. Click the (CLAIM FREE ENTRIES)  tab and follow the instructions to win. No purchase is necessary and No credit card are required to claim your free entries. All qualified entries must comply with the information and instructions available at the (CLAIM FREE ENTRIES) tab. 

3. Entry Details:

• How to Enter: Entry methods will be clearly outlined in all giveaway contest advertisements, brochures, and notices. All online entry forms must be completed accurately. 

• Number of Entries: StreetWaves Corp. may limit the number of entries per participant. This will be specified in the contest announcement.

4. Contest Information:

• Disclosure: All brochures, advertisements, notices, tickets, and entry blanks will include:

• The full name of StreetWaves Corp. and our principal place of business.

• StreetWaves Corp. 14280 South Military Trail, Delray Beach, FL 33484-8314

• The source of funds used for prizes, which include donations and sponsorships.

• The date, hour, and place where the drawing will occur and where prizes will be awarded, or a statement if this information will not be disclosed more than three days before the drawing.

• A clear statement that no purchase or contribution is necessary to enter.

5. Drawing and Winners:

• Selection: Winners will be selected through a random drawing of entries. The drawing will not involve any preselected winners, matching numbers, or instant win mechanisms.

• Notification: Winners will be notified promptly using the contact information provided on their entry forms. If a winner cannot be contacted or does not respond within a reasonable time frame, an alternate winner may be selected or the prize will be reissued for another giveaway. 

6. Prizes:

• Awarding: All prizes listed will be awarded. If any prize cannot be awarded, StreetWaves Corp. will provide an equivalent substitute prize.

• Conditions: No prize may be contingent on additional donations, memberships or purchases.

7. Rules and Regulations:

• Compliance: The contest will be conducted in compliance with Florida state laws, including those outlined in section 849.0935. This includes not requiring any form of payment or donation to enter and ensuring transparency and fairness in the drawing process.

• Disqualification: Entries may be disqualified if they do not meet the contest rules or are deemed to be false or misleading.

8. Promotional Materials:

• Accuracy: All promotional materials, including brochures and advertisements, will be accurate and not deceptive or misleading.

9. Changes and Cancellations:

• Modifications: StreetWaves Corporation. reserves the right to amend or cancel the contest if necessary due to unforeseen circumstances. Any changes will be communicated to participants.

10. Legal Compliance:

• Violation: Any violation of these rules or the applicable state laws may result in disqualification from the contest. Violations of this section may be considered a misdemeanor under Florida law.
